Terms of Service

These Terms of Service (“Terms”) govern the use of Maintena (“Software” or “Service”), developed and operated by Nautipro Connect Solutions (“Provider,” “we,” “us,” “our”).

By installing, accessing, or using Maintena, you (“User,” “Client,” “you”) agree to be bound by these Terms. If you do not agree, you must not use the Software.

Maintena provides a Planned Maintenance System (PMS) for ships and fleets, including:

  1. Offline Desktop Software for vessel maintenance management.
  2. Optional Cloud Synchronization Services for data sharing between vessel and shore.
  3. Support & Update Services as described in your subscription.

Maintena is not a substitute for regulatory compliance. You remain responsible for ensuring your vessel complies with class society, flag state, and ISM Code requirements.

  1. We grant you a limited, non-exclusive, non-transferable license to install and use Maintena for your internal vessel operations.
  2. The license is limited to the number of vessels or installations agreed in your subscription.

  1. Each user (crew, officer, superintendent) may be assigned a role-based account with defined access rights.
  2. You are responsible for managing user accounts and ensuring only authorized personnel have access.
  3. You must maintain the confidentiality of login credentials.

  1. Maintena is provided on an annual subscription basis unless otherwise agreed.
  2. Subscription fees are non-refundable except where required by law.
  3. Failure to pay may result in suspension or termination of cloud services and updates.

  1. Local Data: Maintena stores all data (components, jobs, logbooks, documents) on your local device by default.
  2. Cloud Sync: If enabled, data is encrypted and transmitted securely to our cloud servers for synchronization between vessel and shore.
  3. Data Ownership: You retain full ownership of your operational data. We do not claim any rights over it.
  4. Data Retention: If you cancel the subscription, cloud data will be permanently deleted after 90 days.

  1. We may release updates, patches, or new versions of Maintena.
  2. Support services are provided according to your subscription plan.
  3. We are not obligated to maintain backward compatibility with older versions beyond a reasonable transition period.

When using Maintena, make sure to:

  1. Keep your device secure.
  2. Maintain proper backups of your data.
  3. Use the Software in compliance with applicable class society, ISM Code, and maritime regulations.
  4. Not misuse the Software for unlawful purposes or interfere with its functionality.

Maintena is designed to support regulatory compliance (ISM, IACS, DNVGL-CP-0206, etc.) but does not guarantee compliance on its own.

  1. You remain responsible for ensuring that all maintenance tasks are carried out and recorded correctly.
  2. We are not liable for any class detentions, inspection failures, or operational losses caused by misuse or incomplete data entry.

  1. Maintena and all related documentation remain the intellectual property of Nautipro Connect Solutions.
  2. You are granted only a license to use the Software, not ownership of the source code or design.
  3. You may not decompile or attempt to extract the Software’s source code.

Maintena is provided “as is” without any warranties, express or implied, including:

  1. Any errors or feature requests could be reported through the in-app system.
  2. You acknowledge that maritime environments are complex, and Maintena is a tool to assist—not replace—professional maintenance practices.

To the maximum extent permitted by law:

  1. We are not liable for indirect, incidental, or consequential damages (e.g., loss of profit, off-hire time, detentions).
  2. Our total liability is limited to the amount you paid for the Software in the past 12 months.
  3. We are not liable for data loss due to hardware failure, user error, or force majeure events.

  1. You may stop using Maintena at any time.
  2. We may terminate your license or suspend services if you breach these Terms or fail to pay subscription fees.
  3. Upon termination, you must uninstall the Software and stop using it. You may export your data before termination.

We may update these Terms to reflect new features or legal requirements. We will notify you of major changes before they take effect. Continued use of Maintena after an update means you accept the revised Terms.
